Agreement to Our Terms and Conditions

Artbynikkimolick.com ("the site," "the/this website") is owned and operated by Art by Nikki Molick ("we," "us," "our") PO Box 891 Monticello, MN 55362.

The terms written in this Terms and Conditions ("Terms," "Legal Terms") represent a legally binding agreement between the user ("You") and Art by Nikki Molick regarding your use of our website and the products and services we offer. By purchasing a product or service, or utilizing our website for communication purposes between you and Art by Nikki Molick, you are agreeing to the terms laid out on this page. If you do not agree with all of these Legal Terms, then you are expressly prohibited from purchasing a product or service or otherwise using our website.​

This website provides products and services for purchase by consumers who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the services provided or purchase products on this website.

Intellectual Property Rights

All of the artwork on this website (original art pieces and art prints), photographs, video, audio, and the Art by Nikki Molick logo are the intellectual property of Art by Nikki Molick and the original Artist, Nikki Molick and protected under U.S. Copyright Law. When you purchase an original drawing, physical art print (including the art received through a Print Club membership), or other product or service provided by us, you agree to not reproduce, alter or redistribute that product or service without expressed written consent from Art by Nikki Molick.
We reserve the right to take legal action for violating copyright law of our intellectual property.

Your Submissions
​
When submitting photographs for use by Art by Nikki Molick to create an Original Portrait Drawing ("Commission"), you confirm that your photograph is your original photograph or that you have the rights or licenses necessary to submit such a photograph that Art by Nikki Molick can use as reference for your Commission. You also agree that we may share this photograph, if desired, on our social media platforms for marketing purposes. You are responsible for any reimbursement to us for any and all losses that we may face if you violate any third party's intellectual property rights through submitting a photograph, that you do not own the rights to, for a Commission.

Products and Services
​
While we try our best to accurately display our artwork on our website, we cannot guarantee that the user's computer or device's display is a true depiction of the colors or textures of that artwork. All art prints are made to order, and while we make every effort to ensure each print matches as closely as possible to the next, slight variations of color and cropping may occur from one print to another. If you are unhappy with your artwork, please see the Return & Refund Policy for more information on receiving a refund.

Original Portrait Drawings are completed using colored pencil or graphite pencil. While we do our best to color match exactly as the reference photo portrays, we cannot guarantee an exact match. In ordering an Original Portrait Drawing, you understand this possibility and agree that this does not constitute a refund of this service. While Art by Nikki Molick aims for realism with your Portrait Drawings, it is possible that there may be some slight differences between the reference photograph and the drawing, as expected with any artwork. We make every effort to provide the most accurate drawing of the subject to the best of our ability. Throughout the drawing process, photographic updates will be sent to you, to ensure happiness with the drawing. Before shipping the drawing, you will confirm the drawing is completed to your satisfaction.

While we work hard to create beautiful artwork each month for the Art Print Club ("Print Club"), each print is uniquely different month-to-month, and we cannot guarantee that each print will be of a subject or medium that you prefer. This does not validate a reason for refund. When you subscribe to the Print Club, you understand that the artwork shipped to you each month will be different each time and you do not hold Art by Nikki Molick liable for ensuring your happiness with the subject matter of the products you receive. If at any time you are unsatisfied with the products in the Print Club, you may cancel your subscription to avoid being charged again for this Service.
We reserve the right to discontinue a product at any time for any reason. We reserve the right to cancel any order or subscription for any reason. Prices for products and/or services are subject to change without notice.

Purchases and Payments

When you purchase a product or service from our website, you agree to provide accurate payment and shipping information. If purchasing a subscription service, you consent to us charging you on a recurring monthly basis until you choose to cancel your subscription.

If purchasing a service such as a subscription, you consent to our charging your payment method on a recurring basis (monthly) until you choose to cancel your subscription. You can cancel your subscription at any time for any reason by logging into your account and clicking on the "My Subscriptions" tab, where you can manage your subscription. You may also email us at artbynikkimolick@gmail.com for help with canceling your subscription. Your cancelation will take effect at the end of the current paid term. If you have any questions or are unhappy with your subscription service, please email us at artbynikkimolick@gmail.com.
If purchasing an Original Portrait Drawing, you agree to pay the deposit and the total cost of the drawing as detailed and agreed upon by both Parties in the Artist Portrait Commission Agreement.

We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment for a product or service.

Changes to Products and Services

We reserve the right to change, discontinue or remove products or services from our website at any time for any reason without notice to you and without being held liable to you for such changes, discontinuances or removals of products or services.

Certain products or services are available on a first-come-first-serve basis while our schedule allows. We cannot guarantee our availability to you for our products and services. There may also be a time where technical issues or maintenance on our website result in the disruption of our website and the ability to access our products or services. If a technical issues causes you to not be able to cancel a subscription before being charged during the monthly renewal of said subscription, please reach out to artbynikkimolick@gmail.com for cancellation.

Materials
​
We aim to provide you with the best quality items. We use high quality papers and pencils to create drawings that will last for many years. Our colored pencils are highly resistant to fading over time, but we cannot guarantee that slight fading won't occur at some point. While we hope our drawings will last a lifetime with you, normal wear and tear - including slight fading or minor environmental deterioration - is possible, as with anything. Care instructions are provided to help your drawing last as long as possible. You agree that the Artist is not responsible for such wear and tear or other environmental factors.

Our raw wood ornaments need to be kept out of direct sunlight, as this can cause the raw wood to crack and therefore damage your artwork. Care instructions are included with ornaments to ensure best care methods for your product. You agree that the Artist is not responsible for damages to the artwork caused by normal wear and tear or other environmental factors.

Governing Law
​
These Terms and Conditions and your use of our services are governed by and interpreted in accordance with the laws of the State of Minnesota.

Arbitration
​
Any dispute not resolved amicably through informal negotiations shall be resolved by binding arbitration in Sherburne County, Minnesota under the rules of the American Arbitration Association. Each party is responsible for its own costs.

If, for any reason, a dispute goes to court, the dispute shall be resolved exclusively in the state and federal courts located in Sherburne County, Minnesota.

Limitations of Liability
​
To the fullest extent allowed by the law, our liability for any claim relating to the purchase of an art print, commissioned artwork, or other service is limited to the amount you paid for that product or service.

Electronic Communications, Transactions, and Signatures

When you visit our website and communicate with us via email, form submission or otherwise, you agree and consent to receive electronic communications that may also include forms, orders, invoices, and contracts for products and services. You agree that by electronically signing or typing your name on the Artist Portrait Commission Agreement, that those terms are legally binding.

Miscellaneous

These Terms written by us and posted on our website in regards to our products and services represent the agreement between you and us. Failure by us to enforce or exercise any right or provision of these Terms shall not stand as the foregoing of the right or provision. Lack of professional legal terminology shall not invalidate these Terms. We shall not be held liable for any loss, damage, or delay in our services for anything beyond our control. If any of these provisions, or part of a provision, of these Terms is deemed unlawful, void or unenforceable, that does not affect the validity and effectiveness of the other provisions in these terms. By using our website and services, you are agreeing to these Terms, and therefore you agree not to challenge the validity of these Terms based on their electronic format or the absence of a handwritten signature.
